Welcome to Sumo portal (hereinafter as "portal"). The portal contains a number of different services that can be used by registering for Sumo account (hereinafter as "account"). The portal is provided to you by Sumo Group Ltd (hereinafter as "Sumo", address: PL 950, 00101 Helsinki, Finland). 1. Introduction

The portal may be used without registration, but in order to take full advantage of all the features of the services and tools, you will need to register for an account. The portal is provided by Sumo on an "as is" and "as available" basis and Sumo reserves the right to modify, suspend or discontinue the portal or a part of it, in its sole discretion, at any time and without notice. You agree that Sumo is and will not be liable to you for any modification, suspension or discontinuance of the portal.

2. Registration

To register, you need to provide personal information, such as your username, e-mail address and the password for the account to the service provider. You are entirely responsible for maintaining the confidentiality of your password and account. Furthermore, you are entirely responsible for any and all activities that occur under your account. You agree to notify Sumo immediately of any unauthorized use of your account or any other breach of security at info@sumo.fi.

3. Use of portal

The portal is only for your Personal, non-commercial Use. This excludes any type of Commercial Use, which means use which is undertaken for a business purpose, rather than hobby, recreational, educational or other purposes.

If you're a legal entity or a private person planning to use this portal or parts of it for any type of Commercial Use, such use is subject to a separate arrangement between the Service Provider and You. In principle the Service Provider is open to such Commercial Use arrangements, so please contact us at info@sumo.fi.

By using the portal you accept these terms and you agree to comply with all applicable laws and regulations. Any fraudulent, abusive, or otherwise illegal activity is expressly prohibited. You acknowledge that you are responsible for whatsoever content you submit, and you have the full responsibility for the message, including its legality, reliability, appropriateness, originality, and copyright.

You agree not to use the portal:

  • for any unlawful purposes;
  • to defame, libel, riducile, mock, threaten, harass, intimate or abuse anyone;
  • to upload, post, or otherwise transmit any content that is obscene, offensive, blasphemous, pornographic, unlawful, threatening, menacing, abusive, harmful, an invasion of privacy or publicity rights, defamatory, libelous, vulgar, illegal or otherwise objectionable;
  • to upload, post, or otherwise transmit any content that infringes any copyright, trade mark, patent or other intellectual property right or any moral right or artist's right of any third party including, but not limited to, Sumo;
  • to harm minors in any way, including, but not limited to, uploading, posting, or otherwise transmitting content that violates child pornography laws, child sexual exploitation laws or laws prohibiting the depiction of minors engaged in sexual conduct; or submitting any personally identifiable information about individual;
  • to upload, post, or otherwise transmit any content which is likely to cause harm to Sumo or anyone else's computer systems, including but not limited to that which contains any virus, code, worm, data or other files or programs designed to damage or allow unauthorized access to the portal which may cause any defect, error, malfunction or corruption to the portal;
  • for any commercial purpose, except as expressly permitted under these terms and without approval of Sumo;

You assume all risks associated with use of your content, including any reliance on its accuracy, completeness or usefulness. Violating terms of use may cause immediate cancellation of this contract and may result in legal action against you.

4. Investigations

Sumo reserves the right (but shall have no obligation) to pre-screen, review, flag, filter, modify, refuse or remove any or all content from any service. Sumo disclaims any responsibility for the content submitted by users. Users are entirely responsible for all of their content and information that they upload, post or transmit, including its legality, reliability, appropriateness, originality and copyright. You acknowledge, consent and agree that Sumo may access, preserve and disclose your content at any time if (a) required to do so by law, to (b) comply with legal process, (c) enforce the terms of use, (d) respond to claims that any content violates the rights of third parties, (e) to discover and prevent any security and technical contraventions, (f) respond to your requests for customer service, or (g) protect the rights, property or personal safety of users and the public. Sumo shall have the right, in its sole discretion, to remove or block any of your content or material for any reason (or no reason), including if it violates these terms or any applicable law, and to suspend or terminate your use of the portal.

5. Use of your personal information

Sumo uses your personal information for the following general purposes: to improve our services, contact you, conduct research, customize the advertising and content you see, and to fulfill your requests for products and services. We reserve the right to use, revise, save and disclose information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of these terms of use, or as otherwise required by law.

6. Copyright

You acknowledge and agree that Sumo own all legal right, title and interest in and to the portal, including any intellectual property rights which subsist in the portal (whether those rights happen to be registered or not). User owns and retains sole and exclusive right, title and interest in and to all of your user content. The portal may enable users to develop derivative works based on other users' content. In that case, however, the copyright is owned by the user who created the original work and not by the user who developed the derivative work. Sumo may remove your content submitted to the site, terminate the accounts of users or prevent access to the site by users who infringe the intellectual property rights of others. Sumo has right to use user's public images for Sumo Store prints, unless user disables this option from the image settings. User is entitled to have commission from all images sold from Sumo Store, if the user owns copyright for the original image (and user's account is presented as original author).

7. Acceptance of Terms

This document constitutes the entire agreement between Sumo and you with respect to your use of the portal. You agree to use the services and the materials only for purposes that are permitted by these terms. Sumo may revise these terms of use at any time at its sole discretion and will provide notice of any major change by posting such notice on the site.

8. Privacy

Please review our privacy policy, which governs the use of personal information on the site and to which you agree to be bound as a user of the site.

9. Advertising

You acknowledge and agree that Sumo may advertise on the site and may send you advertisement by email. You may choose to opt-out/unsubscribe from receiving advertisement at any time by following the link at the bottom of each email.

10. Termination

If you want to terminate your account, you may do so by (a) notifying Sumo at any time by sending a notice, by writing, to Sumo. Sumo may at any time terminate its agreement with you if:

  • You have breached any provisions of these terms;
  • Sumo is required to do so by law;
  • Sumo has elected to discontinue the site, services or materials;
  • There has been an extended period of inactivity (12 months) in your account;

Termination of your account includes any or all of the following: (a) removal of access to all or part of the services within the portal and (b) deletion of your password and all related information and user content.

11. Storage Policy

At this time, Sumo provides free online storage of your content to registered users of the portal. However, you acknowledge and agree that Sumo may, at its option, establish limits concerning your use of the portal. Sumo shall have no responsibility or liability for the deletion or failure to store any content maintained on the portal and you are solely responsible for creating back-ups of your content.

12. Security

Sumo will take reasonable precautions to protect personal information in the system from unauthorized access, use or disclosure of personal information or user content, but expressly disclaims any and all liability for the accessing of any such data communications by unauthorized persons or entities. You agree to (a) immediately notify Sumo of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session.

13. Contributions to Sumo portal

We appreciate our customers' interest in improving our services; however, please note our policy on external idea submission: By submitting ideas, suggestions, documents, and/or proposals ("contributions") to Sumo, you acknowledge and agree that: (a) your contributions do not contain confidential or proprietary information; (b) Sumo is not under any obligation of confidentiality, express or implied, with respect to the contributions; (c) Sumo shall be entitled to use or disclose (or choose not to use or disclose) such contributions for any purpose, in any way, in any media worldwide; (d) Sumo may have something similar to the contributions already under consideration or in development; (e) your contributions automatically become the property of Sumo without any obligation of Sumo to you; and (f) you are not entitled to any compensation or reimbursement of any kind from Sumo under any circumstances.
